TinkerTots is offered to parents and guardians for family use. By creating an account, starting a guest session, creating a learner profile, purchasing a subscription, or allowing a child to use TinkerTots, you agree to these Terms for yourself and, where legally permitted, on behalf of that child.
1. Agreement to these Terms
These Terms of Service (“Terms”) are a binding agreement between you and Googly, LLC, doing business as TinkerTots (“TinkerTots,” “we,” “us,” or “our”). They govern access to and use of the TinkerTots mobile applications, website, content, subscriptions, and related services (collectively, the “Services”).
By using the Services, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. Additional terms from Apple, Google, authentication providers, and other services may also apply.
2. Family use and eligibility
You must be legally capable of entering this agreement to create or manage a parent account. If a child uses the Services, a parent or legal guardian must authorize and supervise that use, create or approve the learner profile or guest session, and remain responsible for the child’s activity.
The Services are intended for personal and household educational enrichment. They are not a school, tutoring service, childcare service, or substitute for a qualified educator, caregiver, medical professional, or other professional.
3. Accounts, guest access, and learner profiles
You may access TinkerTots through an anonymous guest account or sign in using supported email, Apple, or Google authentication. Guest progress may be unavailable if the app is removed, the device changes, the guest session ends, or the guest account is not converted to a signed-in account.
You are responsible for:
- maintaining the confidentiality and security of account credentials and the Parent PIN;
- activity performed through your account or guest session;
- providing accurate parent account information;
- using a non-identifying nickname instead of a child’s full legal name;
- reviewing and managing learner profiles, purchases, and privacy choices; and
- notifying us promptly of suspected unauthorized access.
We may limit the number of profiles, guest features, AI interactions, questions, games, or other functionality available under a free or paid plan.
4. The TinkerTots service
TinkerTots offers narrated early-learning activities, tracing and matching exercises, visual learning topics, quizzes, progress tools, AI-assisted explanations, rewards, avatar customization, games, and leaderboards. Features may vary by profile age band, device, platform, country, subscription level, or service availability.
Learning content is designed for enrichment and practice. We work to provide accurate, age-appropriate material, but we do not guarantee that every question, explanation, score, recommendation, or learning summary will be complete, error-free, suitable for every learner, or aligned to a particular school curriculum.
5. AI-assisted content
Some questions, explanations, and performance summaries are generated or analyzed using artificial intelligence. AI output may be inaccurate, incomplete, unexpected, or repetitive. A parent or guardian should use judgment and provide appropriate supervision.
- AI output is not professional, medical, legal, financial, safety, or diagnostic advice.
- Do not submit personal, confidential, or sensitive information through Ask Tinker or other free-text fields.
- You may not use the AI features to create harmful, illegal, abusive, sexually explicit, violent, discriminatory, privacy-invasive, or rights-infringing content.
- Availability, models, limits, and AI providers may change as we improve or maintain the Services.
Use of AI features is also subject to our AI privacy disclosures.
6. Acceptable use
You agree not to misuse the Services or help another person do so. Prohibited conduct includes:
- violating any law, regulation, intellectual property right, privacy right, or these Terms;
- attempting to gain unauthorized access to an account, database, feature, API, or system;
- circumventing subscriptions, limits, age-based features, security controls, or Parent PIN protections;
- uploading or entering malware, abusive content, another person’s personal information, or content you do not have permission to use;
- scraping, harvesting, reverse engineering, decompiling, or using automated means to access the Services except where law expressly permits;
- manipulating scores, Tots, game results, ranks, purchases, or reward balances;
- interfering with the operation, security, integrity, or availability of the Services; or
- using the Services commercially, to train another model, or to build a competing product without our written permission.
7. Profile content, feedback, and leaderboards
Profile nicknames, avatar configurations, feedback, AI prompts, and other information entered into the Services remain yours, subject to the rights needed to operate the Services. You grant TinkerTots a worldwide, non-exclusive, royalty-free license to host, process, reproduce, display, and transmit that content only as reasonably necessary to provide, secure, maintain, and improve the Services.
Leaderboards may display a learner profile nickname, age bracket, Tots earned, game score or completion time, and rank to other authenticated users. Do not use a real full name, school, location, contact information, or other identifying information as a profile nickname. We may remove or modify content and suspend leaderboard access when reasonably necessary for privacy, safety, security, legal compliance, or enforcement of these Terms.
If you send suggestions or product feedback, you permit us to use that feedback without restriction or compensation, but we will handle associated personal information as described in the Privacy Policy.
8. Subscriptions, purchases, and virtual Tots
App-store transactions
Paid subscriptions and in-app purchases are processed by Apple App Store or Google Play and may be managed through RevenueCat. Prices, taxes, billing periods, trials, renewal terms, and available products appear before purchase and may vary by platform or region.
Subscriptions automatically renew unless canceled through the applicable app-store account before the renewal deadline shown by that store. TinkerTots does not receive full payment-card details. Cancellation stops future renewal but does not ordinarily produce a prorated refund. Refund eligibility is determined by the applicable store and governing law. Deleting an account or app does not automatically cancel a subscription.
Virtual currency and items
“Tots,” avatar items, game plays, stickers, badges, levels, and other virtual rewards are licensed features, not money or property. They have no cash value, cannot be redeemed for money, cannot be transferred between users, and may not be sold or traded. We may adjust balances or revoke items when needed to correct an error, address fraud, enforce these Terms, or modify the Services.
Virtual rewards generally remain associated with the related learner profile. They may be lost when a guest session, learner profile, or account is deleted.
9. Ownership and limited license
The Services—including software, designs, text, graphics, illustrations, characters, audio, questions, compilations, trademarks, and other materials—are owned by or licensed to Googly, LLC and protected by intellectual property laws.
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the app on supported devices for non-commercial household use. No ownership rights are transferred. All rights not expressly granted are reserved.
Third-party names, products, app stores, services, and content remain the property of their respective owners. Links to third-party services do not imply endorsement, and those services are governed by their own terms and policies.
10. Availability, changes, and termination
We may add, modify, limit, suspend, or discontinue any portion of the Services, including free features, supported platforms, AI providers, content categories, limits, Tots, games, or subscriptions. We do not guarantee uninterrupted or error-free availability.
You may stop using the Services at any time. Account and data deletion options are described on our Support page. We may suspend or terminate access when we reasonably believe an account violates these Terms, creates risk or harm, is used fraudulently, or must be restricted to comply with law. Where appropriate, we may provide notice and an opportunity to contact support.
Sections that by their nature should survive termination—including ownership, payment obligations, disclaimers, limitations of liability, and general legal terms—will continue to apply.
11. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Services are provided “as is” and “as available.” Googly, LLC disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
To the maximum extent permitted by law, Googly, LLC and its members, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or opportunities, arising from or related to the Services.
To the maximum extent permitted by law, our total liability for claims arising from the Services will not exceed the greater of (a) the amount you paid to TinkerTots through the applicable app store during the 12 months before the event giving rise to the claim or (b) US $100. These limitations do not apply where prohibited by law.
12. General terms
Governing law
These Terms are governed by the laws applicable where Googly, LLC is organized, together with applicable United States federal law, without regard to conflict-of-law rules. Mandatory consumer protections in your place of residence continue to apply. Before filing a formal claim, please contact us so we can try to resolve the concern informally.
Changes to these Terms
We may update these Terms to reflect changes to the Services, providers, law, or business practices. We will update the effective date and provide additional notice where required. Continuing to use the Services after revised Terms become effective means you accept them; otherwise, you must stop using the Services.
Miscellaneous
If a provision is found unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, acquisition, reorganization, or transfer of the Services. These Terms and the Privacy Policy constitute the agreement between you and us regarding the Services, except for any additional terms presented for a specific feature or purchase.
